FRRO Notice to Actor Imran Khan to Leave India by October 28 After CEC Protest Breach

Mumbai: In a sudden turn of events intersecting Bollywood, national politics, and immigration law, the Foreigners Regional Registration Office (FRRO) have served a formal notice to actor Imran Khan, directing him to leave India by October 28, 2026. The directive follows the actor’s active participation in a political demonstration against Chief Election Commissioner (CEC) Gyanesh Kumar.

The 43-year-old actor, best known for his roles in Bollywood hits such as Jaane Tu… Ya Jaane Na and Delhi Belly, holds United States citizenship. Authorities stated that as a foreign national, his participation in political rallies on Indian soil constitutes a direct violation of Indian immigration regulations and the Foreigners Act.

Anti-CEC Demonstration and Political Fallout

The controversy stems from an October 10 protest held in Mumbai demanding the resignation of CEC Gyanesh Kumar over contentious voter list revisions—a political flashpoint raised by opposition parties including the INDIA bloc.

During the demonstration, Khan was spotted participating alongside protesters before being briefly detained. On the day of the rally, the actor posted a picture on Instagram from inside what appeared to be a police transport vehicle, accompanied by a caption stating, “Apparently I’m going for a drive,” while showing a victory sign.

The incident swiftly triggered political reactions. Political leader Kirit Somaiya filed an official complaint with the Gamdevi police station and the FRRO Immigration Division at Mumbai Airport, seeking inquiry and regulatory action against Khan.

“Imran Khan is a foreign citizen, and his participation in political demonstrations is illegal under Indian law. Overseas Citizen of India (OCI) cardholders and foreign nationals cannot engage in political activities on Indian soil,” Somaiya alleged following his complaint.”

Gamdevi Police subsequently forwarded the complaint to the competent immigration authority, led by Deputy Commissioner of Police Samay Munde at the FRRO, which determined that a violation of visa and foreign registration conditions had taken place.

What the Law Says: OCI Status and Political Rights

While Imran Khan possesses an Overseas Citizen of India (OCI) card—a status granting lifelong multiple-entry rights and various financial and educational privileges—the legal framework explicitly distinguishes OCI status from full Indian citizenship.

Under the provisions of the Foreigners Act and the Registration of Foreigners Rules:

  • No Political Rights: Constitutional guarantees under Article 19, including the right to peaceful assembly and freedom of political expression, are strictly reserved for Indian citizens.

  • Prohibition on Political Activity: Foreign nationals and OCI cardholders are legally barred from participating in political campaigns, rallies, or anti-government demonstrations.

  • Power to Deport / Removal Directives: Competent authorities under the Foreigners Regional Registration Office hold statutory powers to direct any foreign national who breaches visa or immigration terms to depart the country within a specified timeframe.

Legal experts note that while the cancellation of OCI registration under Section 7D requires a separate formal hearing process, issuing a leave-India notice under immigration enforcement remains an independent administrative power exercised by authorities.

Actor Prepares Legal Challenge in Bombay High Court

In response to the departure order, legal representatives for Imran Khan confirmed that the actor is preparing to move the Bombay High Court to challenge the notice before the October 28 deadline.

The upcoming petition is expected to contest whether merely attending or observing a public assembly amounts to active political participation warranting removal from the country. Counsel representing the actor will likely seek urgent interim relief staying the operation of the FRRO notice while the court examines the constitutional and procedural validity of the order.

Broader Implications for Foreign Nationals in India

The action against the Bollywood figure highlights the tight administrative controls enforced by Indian immigration authorities regarding foreign citizens and OCI holders engaging in public agitation.

As the October 28 deadline approaches, all eyes remain on the Bombay High Court, where the upcoming legal battle is expected to set a key judicial precedent on the boundaries of foreign national conduct, freedom of expression, and immigration enforcement in India.
